These Terms of Service ("Terms") govern your access to and use of the BusFleetAI website at busfleetai.com and any related services. BusFleetAI is a product of The Phoenix Ascensions Group Inc. ("we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms.

BusFleetAI provides AI-powered bus fleet monitoring software that integrates with existing fleet management platforms including Saucon TDS, Zonar, and Geotab. Our services include automated alerts for driver no-shows, speed violations, DVIR compliance, excessive idling, and daily operations summaries.

2. Eligibility

Our services are intended for use by bus fleet operators, transportation companies, and their authorized representatives. You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.

3. Account and Access

Access to BusFleetAI monitoring services requires a paid subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

BusFleetAI accesses fleet data from your connected platform (Saucon TDS, Zonar, or Geotab) solely to provide the monitoring and alerting services you have subscribed to. We do not claim ownership of your fleet data. You retain all rights to your operational data.

6. Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. Our services depend on the availability and accuracy of data from your fleet management platform. BusFleetAI is not responsible for service interruptions caused by third-party platform outages, network failures, or circumstances beyond our reasonable control.

7. Pricing and Payment

Service pricing is based on fleet size and selected plan tier. Current pricing starts at less than $10 per bus per month. Specific pricing is provided in your service agreement. We reserve the right to modify pricing with 30 days advance notice.

8. Cancellation

You may cancel your subscription at any time by contacting us at Isaias@InteliaRD.com. There are no long-term contracts. Cancellation takes effect at the end of the current billing period.

9. Limitation of Liability

BusFleetAI provides monitoring and alerting services based on data from third-party fleet platforms. We do not guarantee the accuracy, completeness, or timeliness of data provided by those platforms. To the maximum extent permitted by law, BusFleetAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to missed alerts, delayed notifications, or decisions made based on information provided by our system.

You agree to indemnify and hold harmless BusFleetAI, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of our services or violation of these Terms.

11. Intellectual Property

All content, software, design, and branding on the BusFleetAI website and platform are the property of BusFleetAI and are protected by intellectual property laws. You may not copy, modify, or distribute our content without written permission.

12. Modifications to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration.
